One of the questions we hear most often at kitchen tables across Oldham and Rochdale is: 'Will the council sell our house to pay for care?' It's a genuine worry — and a Protective Property Trust is one tool that can help protect your share of the family home for your children.

What is a Protective Property Trust?

A Protective Property Trust is a type of trust written into your Will. When used alongside owning your home as 'tenants in common' (rather than joint tenants), it ringfences your half of the property so that, after you pass away, your share passes into a trust rather than automatically to your partner.

  • Your surviving partner keeps the right to live in the home for the rest of their life.
  • Your share is protected for your children — it can't be spent, remarried away, or swallowed by a future partner's care fees.
  • It's especially valuable in blended families where children from previous relationships could otherwise lose out.

An honest word on what a trust can and can't do

It's important to be straight with you: a Property Trust is not a magic shield against every situation. Deliberate deprivation of assets — giving away or restructuring property specifically to avoid care fees when you already need care — can be challenged by local authorities. Trusts work best when they're set up as part of sensible, long-term estate planning, not as a last-minute fix.

"The earlier you plan, the more options you have. Trusts are about peace of mind for your family's future, not loopholes."
